Terms and Conditions

Our commitment is to make our auctions both fair and transparent. We have a few general terms and conditions to any auction::

  1. All bids submitted at any or our auctions, whether in person or by proxy (or online if an auction is conducted in that manner) will be final and irrevocable. If you are the highest bidder on an item and the item is sold, you are considered the owner and are expected to pay in full. All sales are considered final. Any item immediately becomes the responsibility of the new owner as soon as the auctioneer announces that the item is sold, and if you are the new owner you are immediately responsible for taking possession of the item (after full payment) and securing insurance on the item.

  2. All items at one of our auctions are sold "as is, where is," meaning that we make no guarantees or warranties concerning any item. We expect each bidder to inspect an item and/or read any information pertaining to an item before bidding.

  3. Before bidding on an item at one of our auctions, you must first read and accept, by your signature, the written Terms and Conditions of bidding. Upon acceptance of the Terms and Conditions, we will consider this a binding legal agreement between Wind River and you concerning the terms and conditions of your participation in one of our auctions.

  4. Wind River expressly prohibits any owners and their agents from bidding on any item at a Wind River auction that has been consigned to us. This applies to any context, whether it is on-site, online (if applicable) and proxy bidding.

  5. All items purchased at our auctions must be paid for strictly in accordance with the payment terms in the details of each auction.

  6. A buyer cannot take possession of an item purchased at an auction until full payment is made. Items must be removed from the auction site by the time specified in the auction details.

  7. If for some reason we are unable to provide the buyer with clear title on a purchase (which occurs very infrequently), Wind River will immediately provide you with a full refund of the purchase price.

  8. The terms and conditions of any particular auction may vary by jurisdiction (state) in which an auction is held. Such terms will be governed by the laws of that particular jurisdiction.

  9. The terms and conditions outlined above do not constitute all of the terms and conditions of bidding or of any particular auction, which will be set forth in a specific Terms and Conditions that you will be expected to sign before participating in such auction.
